Terms and Conditions of Sale and Supply for purchases made on es.ecco.com (hereinafter, the "Website").
1. Introduction

(hereinafter referred to as "ECCO", "we" and "our").
These Terms and Conditions of Sale and Delivery apply to the purchase and delivery of goods on the Website for delivery within Spain. If you wish to receive our products in another country, please visit the corresponding website.
2. Ordering and purchasing products
Products
The products we sell online are displayed on this website and include, among others, footwear, bags, and shoe care products.
Buys
By placing an order and clicking the "reserve and pay" button, you agree to purchase a product subject to the following conditions.
To purchase our products you must be over 18 years of age and possess a valid credit or debit card, as specified in clause 2.5.
If your order is accepted, we will inform you by email.
By placing an order, you agree that all the information you provide is truthful and accurate, that you are an authorized user of the credit card, debit card or other payment method used to place the order, and that you have sufficient funds to cover the total purchase price and shipping costs.
Acknowledgement of receipt of your order and confirmation thereof
When you place an order, you will receive an email confirmation. This email will only serve as an acknowledgment of your product reservation and will not constitute acceptance of your order.
No contract for the purchase of goods will be formed between us until your order is ready for shipment, at which time we will send you an order confirmation, invoice, and shipping information. Therefore, the contract is formed when we send you the order confirmation.
You agree that all communication relating to the order, including order confirmation, invoice, delivery information, confirmation of the conclusion of the contract, etc., will be carried out by email.
Price and availability
All prices for products available on the Website are listed in US dollars and include taxes (these are gross amounts). Shipping costs are displayed on the homepage and calculated in the shopping cart. Free shipping promotions may be available and will also be displayed in the shopping cart.
All orders are subject to availability and confirmation, as there may be rare occasions where, for example, two orders are placed for the exact same product and only one is available to ship.
We reserve the right to cancel an order if delivery is not possible. You will be notified if this occurs, and any payments or reservations made with your payment card or other payment method will be refunded or cancelled.
We may occasionally offer limited-edition collections of products. This means that if you wish to exchange or make a valid complaint regarding such products, it may not always be possible to provide you with a similar item. In such cases, we will refund the purchase price.
Pay
Information about the payment method you wish to use must be provided when placing an order on the Website.
Upon receiving your order, we perform a standard pre-authorization for credit or debit cards and a check for bank transfers. This ensures sufficient funds are available for the transaction. Products will not be shipped until this pre-authorization check is complete. Your card will be charged once the order has been accepted and we are in the process of shipping the products. For bank transfers, the amount will be debited from your account as soon as the order is placed.
We accept the following cards: Visa, Visa Electron, Mastercard credit and Mastercard debit.
When you pay by credit or debit card, we will reserve the total amount in your account and only charge your card when your products are shipped.
Your connection with us is always secure and encrypted with 256 bits.
ECCO's online store uses 3D Secure Visa and Mastercard.
For security reasons, we do not store any payment information in our database.
Discount code
We may occasionally offer promotional discount codes, which can be applied to any purchase, or to certain specific purchases, made through this Website.
The potential terms of use relating to any discount code will be specified at the time of the campaign.
3. Delivery
We will try to ship and deliver your order as soon as possible. However, delivery times may vary depending on availability. Any guarantees or statements regarding delivery times are subject to delays caused by postal delays or force majeure.
All products purchased on the Website are delivered under a shipping agreement. The service provider is ASAP. Consequently, the risk of loss and title to the purchased products pass to you upon delivery to the designated address. Delivery will be made within 3-4 business days after receipt of your order. The time required for delivery includes the time needed to prepare the goods for shipment and the corresponding delivery time.
4. Descriptions
We strive to describe our products as accurately as possible. However, errors can occur. If a product purchased on the Website does not match its description, your only recourse is to return the unused product. Please see below for instructions on how to return a product.
5. Cancellation and refunds
You can cancel an order up until the time of shipment by contacting our customer service department (see contact details below in clause 9). If we have received payment, you will be refunded in full via your original payment method.
When you shop with us, we want you to be completely satisfied. If you are not happy with a purchase made on the Website, you can cancel the contract with us and return the ordered products for a full refund. We can only accept returns for purchases made through this Website. All purchases made through another ECCO retail outlet must be returned to the original point of purchase.
Returns must be registered at returns.ecco.com. The 30-day period begins from the date the ordered products are delivered.
You can send your notice of withdrawal in any form and by any means of correspondence. You can also use the model return form attached to these Terms and Conditions of Sale and Delivery. You must also return the goods purchased under the withdrawn contract within 14 days of the date of withdrawal.
We will refund the purchase price of the goods covered by the cancelled contract no later than 14 days from the date we receive your withdrawal notice. However, please note that we may withhold the refund until we have received the returned goods.
To expedite the return and refund of the purchase price, you can follow our return procedure:
How to return an item (the easy way):
Step 1 : Repackage your items in the original shoe box without mailing labels.
Step 2 : Log in to our returns portal. You will need your order number and email address. The order number is found in your order confirmation email.
Step 3 : Print the label that has been generated on the portal.
Step 4 : Place the prepaid return label on your box (please do not stick the prepaid return label on the original shoe box).
Step 5 : Deliver the package to the nearest drop-off point.
Returns may take some time
Please allow approximately 10 days for your return to arrive at our warehouse. We strongly recommend that you register your return at returns.ecco.com and keep your receipt as proof of postage.
Your refund will be processed to your original payment method within 2 business days of receiving your returned merchandise at our warehouse. You will be notified by email once this transaction has been completed.
Your bank may need additional days to process and record the "refund" transaction in your account once they have received the information from us.
Please note that if you do not use the prepaid return label supplied, you will be responsible for the merchandise until it reaches us at the designated return address.
If you do not use the prepaid return label provided to return the goods, you will be responsible for the direct return shipping costs. We will cover the return shipping costs if we have sent you incorrect or defective products.
Returned goods must not be used unnecessarily so that we can verify their nature, characteristics, and functionality. You may try on the products, but you must not use them. If you return a used, worn, or washed item that has not been approved by our quality control, we will not be able to accept it and therefore will not be able to send a replacement. If you receive a defective/incorrect item or a damaged package with missing items, the easiest way to resolve this is to send us photographic evidence. Please send a photo to our customer service department so we can investigate further. We are then responsible for the return once it has been accepted (see contact details below in clause 9).
In accordance with the return instructions on the Return Authorization form, we will refund your payment. We can only issue a refund to the same card used for the purchase. We will not take ownership of the returned goods until the item arrives at the designated return address. Other return policies may apply to certain products and product lines.

6. Product warranty and claims management
We are obligated to deliver the requested merchandise free of defects.
In the event that the ordered merchandise has defects, you have the right to:

submit a declaration for price reduction;

terminate the contract;

demand the replacement of the defective product with a defect-free product; or
-
demand that we eliminate the defects.
The right to request a price reduction or contract termination does not apply if we promptly and without undue inconvenience replace the defective product with a defect-free one or immediately remedy the defect. This limitation also does not apply if we have already replaced or repaired the product, or if we have failed to fulfill our obligation to replace the product with a defect-free one or remedy the defect.
You can request a replacement with a defect-free product instead of the proposed defect removal, or request the defect removal instead of the proposed replacement with a defect-free product.
If it is impossible to eliminate the defect and bring the product into conformity with the contract in the way you choose, or if it involves excessive cost compared to the way we propose, we may replace the defective product with a defect-free product regardless of your request to do so.
If you have any complaints about the products you have received, please contact our customer service department (see contact details below in clause 9) where you will find out how to proceed and what information we need to process your complaint.
We will confirm receipt of your complaint and respond to your request within 14 days. Otherwise, if you have requested a replacement or repair of the defect, or have submitted a price reduction request specifying the amount by which the price should be reduced, we will consider your request justified and will be obliged to comply.
We are responsible for product defects if they are discovered within two years of the delivery date. Your claim for a defect-free replacement is limited to one year from the date the defect was discovered. However, this limitation period will remain in effect until two years have elapsed from the delivery date. Your right to withdraw from the contract or request a price reduction due to product defects is also limited to one year from the date the defect was discovered. However, if you have requested a replacement or defect-free replacement, the deadline for submitting a withdrawal request or a price reduction request begins after the deadline for replacement or defect removal has passed.
7. Applicable law and competent jurisdiction
These Terms of Sale and Supply shall be governed by and construed in accordance with the laws of Spain, without giving effect to its conflict of law provisions. A printed version of these Terms of Sale and Supply shall be admissible in judicial and administrative proceedings based upon or relating to these Terms of Sale and Supply to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Any dispute or claim arising from or related to these Terms of Sale and Supply or your purchase of any product from the Website will be resolved by the competent courts of Spain.
8. Alternative dispute resolution methods
The use of alternative dispute resolution methods is voluntary. The following provisions are for informational purposes only and do not constitute any obligation for either you or ECCO.
